Buggying Bcn’s business is the rental of baby buggies for a minimum rental period of one day under the commercial tradename “Buggying Bcn”.

These General Terms and Conditions for Booking may be amended or modified with specific terms for each service. Therefore, the user (hereinafter, the Client) agrees to read the relevant specific conditions before requesting and using each service.

Buggying Bcn’s range of services and current price schedule are available on its website, www.buggyingbcn.com

Buggying Bcn cannot be held liable for any damages with regard to technical incidents that may affect access to the Internet or the electronic device used to make the booking and which may in any way affect the completion of the booking. In this sense, such technical incidents include, among others: interference, omissions, interruptions, computer viruses, breakdowns and/or impeded connection affecting the operating performance of the electronic system or users’ computer hardware or peripheral devices, etc.

For his/her part, the Client is responsible for checking the contract once the booking has been processed and must notify Buggying Bcn of any incidents that may have occurred during the contracting procedure so that the situation can be quickly resolved to the benefit of both parties.

Should any of these General Terms and Conditions not be applicable (including any provision that excludes our liability), all other points in the Contract shall remain in full force.

3. CONTRACT

3.A  Rental of the buggy is subject to availability. As soon as your order form is received, you will be sent an e-mail at the address provided to confirm the booking.

3.B  Except by prior written and signed agreement between the Client and Buggying Bcn, payment of the rental fee is subject to the following conditions:

Payment shall be made on booking by bank transfer and/or credit card. Nevertheless, Buggying Bcn reserves the right to accept other means of payment.

3.C  Once payment of the service fee has been received, Buggying Bcn shall send an e-mail to confirm the booking.

The legal contract between the Client and Buggying Bcn is effective as of this stage.

3.D  Rental periods are for 24 hours minimum from the moment the buggy is made available to you and recorded on the delivery slip.

4. PRICE, DEPOSIT AND DELIVERY/COLLECTION CHARGES

4.A The rental fee is as shown on our website, which includes the charge for the first 24 hours and also the hourly rate for rental periods of between 24 and 48 hours.

4.B In addition, Buggying Bcn requires a deposit, the amount of which is also shown on our Internet website.

4.C All prices do not include VAT.

5. TERRITORIAL RESTRICTIONS

5.A  The territorial scope of this Contract is continental Spain and the Balearic Islands, and the offshore territories of Spain (Canary Islands, Ceuta and Melilla) are expressly excluded. Transferring the buggy to the Balearic Islands is only authorised when the crossing is made by sea.

5.B The client expressly agrees not to take the buggy out of the geographical areas indicated in paragraph 5.A above, nor to transport it or to check it onto air flights.

6. CLIENT’S RIGHTS TO CANCEL OR MODIFY CONTRACT

6.A Cancellation and/or modification of the contract is free of charge provided that said cancellation/modification takes place at least 48 hours prior to the rental period. Cancellation within 48 hours prior to the commencement of the rental period may be subject to payment of 50% of the agreed rental fee while the full amount of the deposit shall be returned to the Client.

6.B The Contract may not be cancelled once the rental period has commenced.

6.C The Contract may be modified free of charge to extend the services contracted therein, provided that said modification takes place at least 48 hours prior to the rental period,  subject to availability of the additional items requested.
Changes made within 48 hours prior to the commencement of the rental may be subject to payment of 50% of the agreed rental fee.  

6.D All requests for cancellation/modification in accordance with the above terms should be sent via e-mail to the following address: reservas@buggyinbcn.com. Cancellation shall become effective as soon as such notification has been received within normal Spanish working hours, i.e. 09.00-19.00 CET.

6.E Modification is subject to the terms outlined in paragraph 5.3. and shall be accepted by Buggying Bcn in writing.    


7. DELIVERY OF GOODS

7.A Delivery of the buggy is restricted to the city limits of Barcelona and shall take place at the address you indicated on the booking form or at any of the pre-established pick-up points listed on our website.

7.B Delivery at the address indicated by you shall take place at the time agreed between you and Buggying Bcn in the e-mail confirming your booking but always between 9.00am and 9.00pm Spanish time.

Delivery at the pre-established pick-up points shall take place at the times shown on the website.

7.C Outside the above timetable, the buggy shall be made available to the Client at the agreed place of delivery (home or pick-up point) as from 9.00am the following morning.

7.D The buggy shall only be delivered to the person who has contracted the service and whose details were provided in the booking e-mail, or to persons previously authorised on the booking form, provided that identification is shown (ID card/passport).

7.E The rented buggy shall be collected at the end of the rental period at the time previously agreed in the e-mail confirmation of the booking.

8. RETURNING THE DEPOSIT

The deposit shall be reimbursed in full provided that the buggy is returned on the last day of the rental period in the same condition as when it was delivered (save for normal wear and tear), and with all the accessories provided with it (sun-shade, rain canopy, carry basket, and protective cover).

Should the buggy be returned late or damaged, we reserve the right to withhold the deposit and to add an additional surcharge for the extra hours until it is returned and to cover any material damage as per the attached price schedule.

9. CLIENT’S OBLIGATIONS

The Client pledges to:

a)  check the buggy on delivery to make sure it is free of damage, clean and fully equipped (understood to be a buggy delivered with sun-shade, rain canopy, basket and protective cover) and meets his/her requirements.

b) Should this not be the case, please notify us immediately so that Buggying Bcn can take whatever measures may be necessary to solve the problem as soon as possible.

c) The Company cannot accept liability for claims that have not been duly notified upon delivery.

d) Do not exceed the maximum weight load for the buggy, which is 25 kgs. The Company will not accept liability for any direct or indirect damage occurring as a result of the buggy being used by persons weighing more than 25 kgs.

e) Please take good care of and watch over the equipment.

f) Please use the equipment according to the instructions and for the sole purpose with which it has been rented.

g) Should the buggy or any part thereof be stolen, please report the event immediately to the Spanish National Police and inform Buggying Bcn of the robbery by telephoning +34 93 685 56 59.

h) Please hand in a signed Damage and/or Loss of Goods Form together with the return slip when you give the buggy back at the end of the rental period.

Provided that the above steps have been taken properly, Buggying Bcn will be pleased to offer a replacement buggy and the deposit shall be reimbursed without further charge.

10.  BUGGYING BCN LIABILITY

Should the buggy delivered to you be damaged, defective or incomplete, Buggying Bcn shall not be liable for the equipment until the company is notified of the former.

11. FORCE MAJEURE

Buggying Bcn shall not be held liable for any delays or inability to deliver the equipment or minor defects that it may undergo as a result of circumstances beyond the reasonable control of the Company, such as industrial action, disputes or deadlocks, system crashes or network access difficulties, explosions or accidents.

12. PROPERTY
All rented equipment and goods shall remain the property of Buggying Bcn at all times.

13. JURISDICTION

This Contract is governed by Spanish law. The parties hereby agree to submit any incidents, questions or disputes arising from the interpretation or enactment of this Contract to the law courts of Barcelona and expressly waive all rights to any other jurisdiction to which they may be entitled.
